ALCOR SYSTEM SAS - General Terms of Sale
Applicable from 05 November 2021
ALCOR SYSTEM complies with the legislation in terms of distance selling and undertakes to respect its obligations in this area as best as possible.
The information below gathers the points concerned. Bye validating an order of our products, you contractually accept the “General Sales Condition” described below.
In all that follows :
« We» or « our » refers to ALCOR SYSTEM SAS
« Your » or « Your » refers to the customer/buyer.
Article 1) Orders
You can place your orders by mail or email. There is no minimum amount per order. Only a written order accepted ans signed by the customer acts as a contract and this either in writing or by email. It is only binding for ALCOR SYSTEM SAS if it does not contain any errors or anomalies in the designation and price of the products.
Article 2) Deliveries
The products in stock are shipped as soon as possible by mail or any other appropriate and similar means. In case of manufacturing and/or purchasing delays, you will be informed of the indicative delay on the quotation until shipment.
In the event of unavailability of products after placing your order or if the delays are too excessive, we will inform you by e-mail or by mail upon receipt of the information received by the suppliers. In this case, your order can be cancelled after discussion of both parties, and you will be immediately refunded, if your payment of a deposit or the totality was already made with ALCOR SYSTEM SAS. Bank transfer fees cannot be refunded.
Article 3) Prices
ALCOR SYSTEM SAS reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in force at the time of the registration of the order.
The prices are indicated without taxes (HT). The VAT is due for any purchaser in France and European Union, except if the purchaser has an intra-community VAT number. ALCOR SYSTEM SAS collects the VAT under the number FR 05 823626254.
Article 4) Payment
For all the customers, Paypal can be accepted only for amounts less than 500€ and the related fees are charged to the customer.
- For all customers in France, the most appropriate means of payment is the check issued by a bank domiciled in France. The transfer or money order can also be used. A RIB will be sent to you on request.
In the case of an order with a deposit, this one will be cashed as of the order and the balance claimed and due before the forwarding. The products will have to be paid by the customer in their entirety before forwarding including the carriage costs, and the banking charges. - For other customers (outside France), the total amount or 50% must be paid at the time of the order. The easiest way to pay is by bank transfer. An international RIB will be sent to you on request. Western Union type transfers (or transfers with similar mechanisms) are not accepted. The products must be paid by the customer in full before shipping. The customer will be responsible for any bank transfer fees, customs fees, or any other existing payment fees.
- Some compaies or administrations may ask for the application of their own purchasing conditions (payment terms or payment after delivery for example). We will then look for the best compromise together. This is not allowed for sales to individuals.
Article 5) Property reserve
The delivered products remain the property of ALCOR SYSTEM SAS until the full payment of the invoiced amount. The interests at the legal rate, the expenses of recall and administrative related to the delay of payment can be invoiced to the customer. Products returned for non-payment may be subject to a discount depending on their condition and wear, and this discount may be paid by the unscrupulous customer.
Article 6) Non-contractual characteristics
The information, characteristics, technical data, images, and prices are given as an indication and are not contractual before validation or order and/or emission of estimate, and under reserve of error.
Article 7) Intellectual property
All texts, comments, works, illustrations and images repoduced on our site www.alcor-system.com are reserved under the copyright as well as under the intellectual property and the whole world. As such and in accordance with the provisions of the code of intellectual property, only the use for private and use is authorized, subject to different provisions, even more restrictive of the code of intellectual property. Any total or partial reproduction without our authorization is strictly forbidden.
Article 8) Responsibility
The products offered are in conformity with the French legislation in force and the standards applicable in France. ALCOR SYSTEM SAS cannot be held responsible in case of non-compliance with the legislation of the country where the product is delivered (for example in case of prohibition of a product..). It is your responsibility to check with the local authorities the possibilities of importing or using the products or services you are considering ordering.
In the event of professional purchases, ALCOR SYSTEM SAS shall not be liable for any indirect damage due to the present, operating loss, loss of profit, loss of opportunity, damage or expenses that may arise from the purchase of the products. ALCOR SYSTEM SAS products are not designed or intended to be used for medical applications, or any application where the failure of our products could cause injury to persons, or death.
Article 9) Applicable law - disputes
The contract hereby is subject to French law. The language of the hereby contract is the french language. In case of dispute, only the Courts of Saint-Etienne (France) will be competent to decide between the parties.
Article 10) Warranty
All products and goods sold are guaranteed two years against any manufacturing defect. The guarantee starts on the date of receipt of the invoice. The warranty does not cover the elements on which the products and goods sold are mounted or used. The amount of the applicable warranty cannot exceed the price of the sold product. The guarantee is not applicable in case of defect of use and maintenance of the sold product or goods.
In case of return, transportation costs are at the customer’s expense. ALCOR SYSTEM SAS shall be responsible for the return transport costs to the customer if a defect is found and repaired, and to the customer if the product complies with the specifications and/or has not been repaired. ALCOR SYSTEM SAS reserves the right to use any means of transport for the return but must insure the value of the product if if exceeds 150€.
If not repair is carried out because the product is in conformity with the specifications and no failure is detected, the payment of the return transport costs will be the responsibility of the customer.
Article 11) Refunds
The refund of a product is possible within 15 calendar datsn except for a software product.
An email or a traditional mail must be sent to ALCOR SYSTEM SAS explaining the reasons for the refund.
The product will haveto return to us in perfect state and without missing accessories. It will be reimbursed within 30 calendar days after receipt in our premises. ALCOR SYSTEM SAS is not responsible for bank transfer delays.
In case of damageto the product (wear, defective packaging), a discount will be applied to the refund in order to put the product back on the market. Shippint costs are at the customer’s expense (both outbound and return of the product).
